Terms of Service

1. General Terms and Provisions

1.1. Site — a website (or websites) available on the Internet at: https://bothub.center/.

1.2. User — an individual acting in a personal capacity or as a representative of a legal entity, visiting the Site or using the Service either in full or in part, on an onerous or gratuitous basis.

1.3. Administration — the operator and/or owner of the Site, a legal entity BotHub duly registered under the laws of the United States, or its successor, as well as persons duly authorized to represent its interests.

1.4. Telegram — a messaging service available through official applications for Android and iOS, desktop software for Windows, macOS and Linux, and web interfaces available at: https://telegram.org/dl/webz and https://telegram.org/dl/webk.

1.5. Bot — an Administration application publicly available to Users through Telegram and managed via HTTPS requests to the Bot API provided by Telegram Messenger Inc.

1.6. Leak — an incident where data was inadvertently exposed in a computerized system due to insufficient access controls, security measures, or other actions caused by negligence or malicious intent on the part of third parties.

1.7. O.S.I.N.T. / Intelligence — an intelligence discipline and a set of activities, tools, and methods for obtaining and analyzing information from open sources, applied to specific individuals, organizations, websites, hosts, phone numbers, email addresses, and any other resources containing an IP address, as well as events, phenomena, and targets.

1.8. Service — the Site and the Bot within the meaning of this Section, providing, upon the User's request, information on O.S.I.N.T. events and data from publicly available sources regarding Leaks that have occurred on third-party web resources or services. The Service aggregates Leak and intelligence data and helps people assess whether their personal data has been exposed and where.

1.9. Account — an account of the Site User or Bot User, required to access the Service on an onerous basis, created independently by establishing a username, password, and providing a valid email address on the Site, or upon launching the Bot.

1.10. Terms of Service — a license agreement between the Administration and the User governing the use of the Service.

1.11. Plan — the license fee arrangement for using the Service, describing the applicable terms, settlement of license fees, and restrictions established by the Administration.

1.12. OLR — an internal means of payment within the Service for using Bot tools. The actual cost is disclosed to the User when selecting a Plan or topping up the account balance. OLR has the code name "token" and has no fixed value.

1.13. Tool — a software package comprising modules for scanning Internet resources, detecting software flaws and vulnerabilities, CVE analysis, identifying and establishing ownership of IP addresses, scanning IP networks, sorting emails and phone numbers, and performing deep searches for information on websites and within public documents without violating system integrity. The Tool belongs to the Data Source.

1.14. Data Source — a list of publicly available Internet resources that provide a connection to the own system for conducting O.S.I.N.T. events and detecting Leaks via a special API key. The Data Source is a partner of the Site and Bot and belongs to third parties. The full list of Data Source resources may be changed or supplemented without notifying the User. The current list can be found on the Site.

1.15. API key — an encryption key used for user authentication within the system.

1.16. These Terms of Service establish and govern:

1.17. The Administration offers the User the right to use the Service on the following terms. In accordance with the Terms of Service, the Administration grants the User the right to use the Service solely for personal use on the basis of a revocable, non-exclusive, perpetual, and worldwide license — gratuitous or subject to a license fee if the User has opted for a paid Plan.

1.18. By using the Service or any of its individual functions, the User agrees to comply with these Terms of Service, as well as any other terms indicated in the Service interface, in full and without reservations or exclusions.

1.19. If the User disagrees with the content of these Terms of Service, in whole or in part, the User is not entitled to use the Service and is obligated to immediately cease using it.

1.20. The User agrees to comply with all applicable laws and regulations and assumes liability for compliance with any applicable local laws when using the Service. The User is solely liable to third parties for their actions related to the use of the Service, including if such actions lead to a violation of the rights and legitimate interests of third parties, as well as for compliance with the law when using the Service.

1.21. Only a User who has reached the age of legal capacity established by applicable law has the right to independently create an Account and use the Service. If the User has not reached the specified age, or in cases provided for by applicable law, the use of the Service is permitted only with the consent of a parent or other legal representative.

1.22. The Service provides the User with information obtained from the databases of the Data Source. The content of those databases, as owned and operated by the Data Source, is the exclusive property of the Data Source and is not known to the Service. The Service acts as an intermediary for the delivery of information between the User and the Data Source using API keys. The Service does not guarantee the delivery of desired results, as those depend on the availability of information and the capabilities of the Data Source.

1.23. By accepting these Terms, the User acknowledges and agrees that the Administration is not liable for the dissemination of information received through the Service regarding O.S.I.N.T. facts and user data Leaks resulting from actions or inaction of third parties.

1.24. The User acknowledges that the Administration does not have the authority, contractual obligations, or legal obligations to delete or otherwise restrict access to information displayed in the search results of the Site or in the Bot's responses. The Administration may only hide such information upon receipt of a relevant User request. Users seeking to have their personal information erased from third-party sources must contact those Data Sources directly.

1.25. All currently existing functions of the Site or Bot, as well as any improvements to them and/or the addition of new ones, are subject to these Terms of Service.

2. Disclaimer

2.1. The Administration continuously reviews and updates the information available through the Service. The Administration does not guarantee that some information may not be outdated or irrelevant. For these reasons, the information available through the Service is provided "as is", and the Administration is not liable for the relevance, accuracy, and/or completeness of the information displayed, and assumes no liability in this regard.

2.2. The Administration does not bear any liability for the conformity of the Service with the goals or expectations of the User. The Administration does not guarantee the uninterrupted and continuous operation of the Service. At its sole discretion, the Administration may carry out technical or improvement work, including regular maintenance, which may cause temporary full or partial unavailability of the Service. For these reasons, access to the Service is provided "as is" without any guarantees of uptime or continuity.

2.3. The Administration does not guarantee, and nothing in these Terms should be construed as a declaration or representation regarding the accuracy or quality of the information provided, or its suitability for any purpose other than personal, household, or non-commercial use.

2.4. The Administration retains the right to make modifications or additions to the information displayed in the search results of the Site or in the Bot's responses. This includes the right to change the list of Data Sources, which may affect the number of results returned.

2.5. The User assumes all risks associated with the use of the Service and the information obtained through it. In particular, the User is solely responsible for the security and confidentiality of the Account and for the security measures chosen by them. The User is solely responsible for all actions (and their consequences) taken through or in connection with the use of the Service under their Account. All actions performed within or using the Service under the User's Account are deemed to be performed by the User personally.

3. Amendments

3.1. The Administration has the right to amend the Terms of Service without prior notice to the User. The current version of these Terms of Service is available at https://bothub.center/tos. The new version of the Terms of Service, as well as any modifications and additions regarding the Service as a whole or the Site or Bot separately, take effect from the moment they are made publicly available at the address indicated above, unless otherwise specified by the new version.

3.2. If the Administration has made amendments to these Terms with which the User does not agree, the User is obligated to stop using the Service. Otherwise, by continuing to use the Service, the User accepts the new version of the Terms, i.e., agrees to all amendments introduced by the new version of these Terms of Service.

4. Privacy Policy

4.1. The Administration respects the right to privacy and the protection of personal data of all Users. These Terms of Service contain general provisions regarding the processing of various categories of user data. All data collected and processed about the User is necessary to perform these Terms of Service and to pursue the legitimate interests of the Administration in the context of providing the User with access to the Services on an onerous basis. More detailed information on the processing of user data is available in the Privacy Policy published on the Site.

4.2. The Administration does not store data requested by the User for verification on its own servers, and the history of certain User actions is retained in the Account for a limited period of time. However, such storage may be performed by the Data Source.

4.3. The User has the right to use an alternative authorization method selected from the options provided in the authorization form, including using accounts from third-party services or web resources. By choosing an alternative authorization method, the User agrees that the Administration may receive data about the User from third-party information resources. The User is solely responsible for maintaining the security of access to the third-party resource and for controlling the confidentiality of the credentials used.

5. Restrictions and Limitations

5.1. All Accounts and Plans are intended solely for the User's personal, non-commercial use and may not be leased, subleased, sold, assigned, or otherwise transferred to third parties.

5.2. The User is solely responsible for implementing the necessary security measures for the Account and for maintaining the confidentiality of the credentials required for authorization and authentication on the Site or in the Bot.

5.3. The User is not permitted to use the Service to carry out activities:

5.6. The content and structure of the Service are protected by copyright. Reproducing such content or structure — including the use of texts, text excerpts, illustrations, or design elements — requires express prior permission.

5.7. The Administration retains the right to unilaterally determine the severity of each violation and immediately take measures including, but not limited to, suspension or termination of access to the Service, with or without prior notice. Violations may also result in the immediate suspension or termination of the Account, as well as its subsequent deletion.

5.8. Ignoring notifications or messages from the Administration that require a response from the User may result in the suspension or termination of access to the Service.

5.9. Deleted Accounts cannot be reactivated or restored.

5.10. Nothing in this Policy shall be construed as limiting the Administration's actions or its choice of remedies against any prohibited conduct.

5.11. The Administration may, at its sole discretion, deny access to the Service to any User and modify the eligibility criteria for Users at any time, including in cases where a User does not comply with these Terms of Service.

5.12. Pursuant to agreements between the Data Source and the United States and Switzerland, the use of the Service within the digital space of those countries is deactivated. Any attempt to circumvent these restrictions will be considered a violation of these Terms.

5.13. The use of reverse data search by phone number is intended exclusively for Users within the same country, with confirmation of their phone number through the Bot.

5.13.1. When a User has completed the actions described in clause 5.13, the phone number is linked to their profile. If the User subsequently changes their Telegram phone number, the number in the Account will not be updated automatically.

5.14. Certain Tools may, at the discretion of the Data Source, process User requests sequentially to avoid system overload. Before using such Tools, the User will be notified of the estimated queue position and expected waiting time.

6. Plans

6.1. The Service may, at the discretion of the Administration, provide information about Leaks and O.S.I.N.T. events free of charge on a limited basis.

6.2. The right to use the Service free of charge may be limited, suspended, or terminated at any time, unilaterally and without prior notice.

6.3. The User has the right to use the Service on an onerous basis in accordance with the Plans established by the Administration. To exercise this right, the User must:

6.4. The Administration retains the right to suspend or restrict the User's access to the Service, including deleting the User's Account data at any time at its sole discretion, if the User has violated the provisions of Section 5 of these Terms of Service.

6.5. The Administration retains the right to establish any rules and restrictions — technical, legal, organizational, or otherwise — on the use of the Service or any of its functions, and to modify them at its own discretion without prior notice to Users. In particular, the Administration may prohibit the use of certain usernames and set requirements for usernames and passwords. The Administration may also, at its sole discretion, prohibit scanning and O.S.I.N.T. activities for certain resources. These rules and restrictions may vary across different categories of Users.

6.6. The functions and Tools available under various Plans, as well as their scope and limitations, may be changed unilaterally at the Administration's discretion without mandatory prior notice. Using Tools without an active Plan is only possible on a paid basis.

6.7. The actual amounts payable for Plans and Tools can be provided by the Bot upon the User's request. The Administration offers the following Plans:

Each Plan allows Users to use certain Tools for free within daily limits. Daily limits are reset at 10:00 PM (GMT). All Plans are available for periods of 1, 3, and 6 months.

6.8. In order to comply with these Terms of Service, the Administration has the right to instruct a third-party payment provider to collect and process payments from Users on its behalf and in its interests.

6.9. The access period granted to Users begins upon receipt of payment and lasts until the expiration of the period specified in the Plan description. The User agrees that they may be invoiced against their current balance at any time to verify the accuracy of their Account information. The Administration retains the right to deny or limit access to the Service at any time at its sole discretion in cases of non-payment, delayed payment, or inability to charge the User.

6.10. Access to Plans is provided and paid for on a subscription basis. The User acknowledges that they will be billed on a regular basis, and the fee will be charged automatically from the system balance.

6.11. Using certain Tools requires an active Plan. The cost of each Tool is individual, and the usage fee is deducted from the total OLR balance in the Account. If the OLR balance is insufficient, the use of those Tools is not possible until the User tops up the OLR balance.

6.12. When the Plan expires, free use of Tools is suspended until the Plan is reactivated. Unspent OLR tokens remain in the Account.

6.13. If the Plan does not provide for subscription-based settlement of the license fee, access to the Services is granted in the scope and for the period specified in the Plan description, upon receipt of payment. To extend the access period, the User must make a new payment after the initial period expires. Access is granted upon receipt of payment for the term specified in the effective description of the selected Plan, expressed in days, months, or years.

6.14. Additional conditions, restrictions, and queue settings for Bot tasks may be displayed in the Bot before using a Tool. Consent to such additional conditions and restrictions takes effect after the User confirms acknowledgment by pressing the corresponding button in the Bot.

7. Refund Policy

7.1. Since the use of and access to the Services is intangible and irrevocable in nature, the Administration does not provide refunds after payment for Plans or the purchase of OLR.

7.2. Refunds are not provided for the unexpired portion of a Plan period or for unspent OLR tokens.

7.3. If the User changes their Plan or ceases to use the Service, access to the previously paid Plan continues until the expiration of the pre-paid billing period.
